Acceptable Use Policy
This pack contains 18 working-draft legal documents. None of them have been reviewed by Texas counsel or counsel licensed in any other jurisdiction. They are a starting point for a real attorney engagement, not a finished publication. Brackets [highlight] indicate custom options to finalize.
This Acceptable Use Policy ("AUP") describes conduct that is prohibited on the SiteFlows Service. It is part of the Terms of Service and the MSA. Violation may result in suspension or termination, removal of content, or legal action.
1. Prohibited Activities
You will not, and will not permit any other user under your account to:
- Use the Service for any unlawful purpose or in violation of any applicable law, including labor, wage-and-hour, tax, immigration, or anti-discrimination law;
- Misrepresent the relationship between an Operator and a Worker (e.g., misclassifying employees as independent contractors in violation of applicable law);
- Upload, transmit, or generate content that is fraudulent, defamatory, obscene, or that infringes intellectual property rights or leads to spoliation of evidence;
- Attempt to circumvent the locked-pay, dispute, or audit-trail mechanisms of the Service;
- Use the Service to harass, threaten, intimidate, or discriminate against any person;
- Access or attempt to access another user's account, data, or systems without authorization;
- Probe, scan, or test the vulnerability of the Service except under a coordinated disclosure agreement;
- Introduce malware, ransomware, viruses, or any malicious code;
- Scrape, crawl, or harvest data from the Service except as expressly permitted by API terms;
- Resell, sublicense, or commercially exploit the Service without our written consent;
- Use the Service to send unsolicited bulk messages or marketing communications;
- Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure.
2. Worker Pay Tampering
Operators may not retroactively alter Locked Pay without going through the Dispute Engine, Locked Pay is a contractual amount. Operators may not retroactively alter Locked Pay without going through the Dispute Engine, and may not pressure or retaliate against a Worker for filing a dispute. Repeated violations are grounds for immediate termination.
3. Reporting Violations
Include account information, description of the conduct, evidence (screenshots, transcripts), and your contact information. We will investigate and respond within 2 business days.
4. Enforcement
SiteFlows may, at its discretion and without notice in serious cases:
- Investigate violations using audit logs and platform data;
- Warn the user;
- Suspend or restrict features (e.g., disable dispatch);
- Terminate the account;
- Refer the matter to law enforcement;
- Cooperate with legal process initiated by affected parties.
5. Refund Policy for AUP Violations
Accounts terminated for AUP violation are not entitled to refunds for the current billing period.
6. Updates
We may update this AUP from time to time. Material changes will be notified by email and via in-Service notification.
